|Andrew McDonald’s nomination squeaked through the House of Representatives by one vote and was rejected by the Senate. I had raised concerns on this nomination, as I feel that Justice Andrew McDonald legislates from the bench. He is an activist judge. The duties of the three arms of our government; the Legislature, Executive Office, and the Judiciary Branch are well outlined. The Judicial branch implements what was passed by the Legislative branch and signed into law. The judicial branch does not legislate.
Justice Andrew McDonald failed to recuse himself from a very important case and then wrote an opinion. I find that unacceptable. I had the opportunity to discuss these issues and other concerns of mine with Justice McDonald in person prior to the public hearing. I firmly stand behind my “no” vote in the judiciary committee and in the house and I’m glad of the outcome in the Senate.
Connecticut can do better. Connecticut should do better.
